These Terms and Conditions set out the basis on which Waste Clearance Bermondsey provides waste removal and related services to domestic and commercial customers within its service area. By booking a collection, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business or organisation requesting the services.

Company means Waste Clearance Bermondsey, the waste collection service provider.

Services means any waste clearance, rubbish removal, bulky item collection, loading, sorting or related activity carried out by the Company.

Waste means any items, materials or goods presented for collection and disposal, including household waste, commercial waste and bulky items, but excluding any items classified as hazardous or prohibited under applicable law or these terms.

Service Area means the geographical area within which the Company offers its waste collection services, as communicated from time to time by the Company.

2. Scope of Services

The Company provides waste collection and removal services for domestic and commercial customers, including but not limited to general household waste, office clearances, garden waste, and non-hazardous bulky items. The precise scope of each service visit will be set out in the booking confirmation or agreed quotation.

The Company reserves the right to refuse to collect any waste that is unsafe, unlawful to carry, excessively heavy, not as described at the time of booking, or reasonably considered unsuitable for collection by our operatives.

3. Booking Process

3.1 Bookings may be made by telephone or other contact methods accepted by the Company. All bookings are subject to availability and confirmation by the Company.

3.2 When making a booking, the Customer must provide accurate and complete information, including the collection address, contact details, description and approximate volume or weight of the waste, access details, and any special circumstances that may affect the service.

3.3 The Company may provide an estimated price based on the information supplied by the Customer. This estimate may be adjusted on arrival if the actual volume, weight, type of waste, or access conditions differ from those described at the time of booking.

3.4 A booking will be deemed accepted only when the Company confirms the date, time window and any applicable charges. The Company may decline a booking at its discretion.

4. Access and Customer Responsibilities

4.1 The Customer is responsible for ensuring that the Company has safe, convenient and lawful access to the collection point at the agreed time. This includes arranging any necessary permissions, parking, loading access, or entry to communal areas.

4.2 If access is restricted, delayed, or unsafe, the Company may charge a waiting fee, adjust the quotation, or cancel the service and apply a cancellation charge as set out in these terms.

4.3 The Customer must ensure that all waste intended for collection is clearly segregated if required, is not contaminated with hazardous materials, and is presented in a manner that is safe for manual handling by our operatives.

4.4 The Customer warrants that they either own the waste and items presented for collection or have full authority from the owner to dispose of them. The Customer agrees to indemnify the Company against any claim relating to ownership or unauthorised disposal.

5. Pricing and Quotations

5.1 Prices for services are generally based on factors such as the type of waste, estimated volume or weight, labour time, and access conditions. The Company may also apply minimum charges.

5.2 Any quotation given prior to inspection is an estimate only, based on the information provided by the Customer. The Company reserves the right to revise the price upon arrival, once the waste and conditions have been assessed on site.

5.3 If the revised price is not accepted by the Customer, the Company will not be obliged to carry out the service. In such circumstances, a call-out or cancellation fee may apply to cover operational costs.

5.4 All prices are quoted in pounds sterling and may be subject to applicable taxes or statutory charges, which will be clearly stated where relevant.

6. Payments

6.1 Payment is due on completion of the service, unless otherwise agreed in writing in advance. The Company may require partial or full payment in advance for certain bookings, particularly for larger clearances or commercial customers.

6.2 The Company accepts payment by methods notified to the Customer at the time of booking. The Customer must ensure that sufficient funds are available for payment and that the chosen payment method is valid.

6.3 For account customers, payment terms will be specified separately. Unless otherwise agreed, invoices are payable within 14 days of the invoice date. The Company reserves the right to charge interest and reasonable recovery costs on overdue amounts in accordance with applicable legislation.

6.4 Ownership of any items removed by the Company passes to the Company on collection, subject to applicable waste regulations and these terms.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting the Company directly. Any cancellation or amendment is only effective once confirmed by the Company.

7.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, no cancellation charge will normally apply, unless the Company has incurred specific costs that cannot be recovered.

7.3 If the Customer cancels a booking less than 24 hours before the scheduled collection time, or fails to provide access or is not present (where required) when the Company attends, the Company may charge a cancellation or wasted journey fee to cover reasonable costs.

7.4 The Company reserves the right to cancel or reschedule a booking due to events beyond its reasonable control, including but not limited to severe weather, traffic disruption, vehicle breakdown, staff illness, or safety concerns. The Company will notify the Customer as soon as reasonably practicable and will endeavour to offer a new appointment time. In such circumstances, the Company shall not be liable for any loss arising from the cancellation or rescheduling.

8. Service Delivery and Time Windows

8.1 The Company will use reasonable efforts to attend within the agreed time window. However, any times stated are estimates only and are not guaranteed. The Company shall not be liable for any loss or expense incurred by the Customer as a result of delay or late arrival, provided the Company uses reasonable care in planning and delivering the service.

8.2 The Company may contact the Customer prior to arrival to confirm attendance, clarify directions, or discuss any relevant issues. The Customer should be available on the contact number provided at the time of booking.

9. Waste Regulations and Prohibited Items

9.1 The Company operates in accordance with relevant UK waste regulations and duties of care relating to the handling, transport, and disposal of waste. All collected waste will be transported and disposed of using appropriately licensed and authorised facilities where required by law.

9.2 The Customer must not present for collection any hazardous, toxic, explosive, flammable, corrosive, clinical or medical waste, asbestos, gas cylinders, chemicals, oils, fuels, or any other materials prohibited by law or considered unsafe by the Company.

9.3 If prohibited or hazardous items are discovered during collection, the Company may refuse to remove them and may adjust the price or cancel the service. The Customer may be charged for any additional time spent on site or costs incurred in dealing with such items.

9.4 The Customer remains responsible for any waste that is incorrectly described or misdeclared, and agrees to indemnify the Company for any loss, damage, penalty, fine or claim arising from the Company transporting, storing or disposing of such waste in reliance on the Customer's description.

10. Liability and Insurance

10.1 The Company will exercise reasonable care and skill in providing the services. However, the Company's liability to the Customer is limited as set out in this section.

10.2 The Company shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the provision of the services.

10.3 The Company will take reasonable care to avoid damage to property when carrying out collections. Nonetheless, the Customer is responsible for protecting floors, walls, fixtures, fittings and surfaces that may be susceptible to damage during the removal process. The Company will not be liable for cosmetic damage to floors, surfaces or finishes reasonably attributable to the movement of heavy items or waste, provided the Company has acted with reasonable care.

10.4 The Company shall not be liable for any damage or loss arising from defective or unsafe premises, structural issues, or circumstances beyond its control, including where the Customer requires items to be removed from difficult or restricted areas.

10.5 Nothing in these Terms and Conditions limits or excludes the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under applicable law.

10.6 The Company's total liability for any claim arising out of or in connection with the services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable by the Customer for the specific service to which the claim relates.

11. Customer Property and Valuables

11.1 The Customer must remove all personal items, valuables and documents from items intended for disposal prior to collection. Once items have been removed by the Company, they are unlikely to be recoverable.

11.2 The Company accepts no responsibility for any personal possessions or valuables that are disposed of as part of the waste, where the Customer has failed to remove them prior to collection.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the service, they should contact the Company as soon as possible, providing full details of the issue.

12.2 The Company will investigate complaints in a fair and timely manner and will aim to propose a resolution where appropriate. The Customer agrees to give the Company a reasonable opportunity to remedy any service issues before pursuing other remedies.

13. Data Protection and Privacy

13.1 The Company will collect and process personal data such as names, addresses, contact details and payment information for the purpose of managing bookings, providing services, processing payments, and fulfilling its legal obligations.

13.2 The Company will take reasonable steps to keep personal data secure and will not sell or disclose such data to third parties except where necessary to provide the services, process payments, comply with the law, or with the Customer's consent.

14. Force Majeure

14.1 The Company shall not be in breach of these Terms and Conditions, nor liable for any delay or failure in performance, if such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include, without limitation, severe weather, natural disasters, accidents, breakdowns, strikes, public health emergencies, or acts of government.

15. Variations

15.1 The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will govern the contract for that particular service, unless changes are required by law.

15.2 Any additional terms or variations requested by the Customer will only be effective if agreed in writing by the Company.

16. Severability

16.1 If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
